TERMS AND CONDITIONS

WHITE STAMP LDA, legal person number 516630628, with registered office at Rua de São Tomé e Príncipe 8, 3800-386 Aveiro, Portugal, henceforth referred to as “WHITE STAMP”.
The SELL 1 BUY 1 program is operated by WHITE STAMP, in partnership with several fashion brands. The SELL 1 BUY 1 program allows users to exchange 2nd-Hand Items with value and in good condition for credit to spend on new purchases in the Partner Brands. This document details the terms of the agreement, including the exchange process for the items, the use of credit and other terms related to the SELL 1 BUY 1 program. The User acknowledges that, although credit is used in the Partner Brands, the entire process is managed by WHITE STAMP.
The use of WHITE STAMP's Sites and Services through the SELL 1 BUY 1 Program presupposes the User's knowledge, understanding and acceptance of these Terms and Conditions.

1. DEFINITIONS
1.1 For the purposes of these Terms and Conditions:
WHITE STAMP LDA: legal person number 516630628, with registered office at Rua de São Tomé e Príncipe 8, 3800-386 Aveiro, Portugal, henceforth referred to as “WHITE STAMP”. In these Terms and Conditions, WHITE STAMP is sometimes referred to as "we" or "our", depending on the context.
SELL 1 BUY 1 Program: program that offers the functionality of exchanging 2nd Hand Items for credit to be discounted on new purchases in the Partner Brands.
Partner Brands: brands that are part of the WHITE STAMP SELL 1 BUY 1 Program. They promote the SELL 1 BUY 1 Program and allow the User to discount the credit he accumulates with 2nd Hand Items sent to WHITE STAMP, when purchasing new items.
User: any natural person, non-merchant, who accesses the Sites or uses the Services and who has established a relationship with WHITE STAMP (for example, when making an exchange, when creating a SELL 1 BUY 1 Account, when creating discount codes , and agree to the WHITE STAMP Terms and Conditions).
SELL 1 BUY 1 Account: is the User's personal account in the SELL 1 BUY 1 Program, where information such as name, surname, e-mail address and password are kept.
Sales Form: electronic form completed by the User that contains the characteristics of the 2nd Hand item to be exchanged for credit, and which gives access to its quotation.
2nd Hand Items: Fashion items (used or new) that are owned by the User.
Personal Data: information that can be associated with an identified natural person or directly or indirectly identifiable. "Personal Data" may include, but are not limited to, name, address (including shipping addresses), telephone number, email address.
Services: all services, contents, functionalities, technologies or functions and all websites, applications and related services made available by WHITE STAMP.
Sites: Sites (www.white-stamp.com and its extensions), applications for mobile devices, official social media platforms or other online properties through which WHITE STAMP provides its Services.

2. REGISTRATION ON THE SITES
2.1 To use our Services for the first time, the User will have to register by filling in the fields contained in the registration form on the Sites. By registering on our Sites, your data and preferences will be saved to be more easily accessed in future uses.
2.2 After completing the registration, the User has access to his SELL 1 BUY 1 Account, where he can exchange 2nd Hand Items for credit, check his credit, check his discounts, create and cancel discount codes, manage his personal data and contact preferences.
2.3 From the moment you access your SELL 1 BUY 1 Account, you are bound by these Terms and Conditions.

3. SUBMISSION OF THE 2ND HAND ITEMS
3.1 All items proposed for credit exchange through our Sites are subject to approval by WHITE STAMP. As part of this approval process, the User must complete the Sales Form that will be made available on the website.
3.2 The Sales Form requires the User to fill in all the description fields for each 2nd Hand Item that he wishes to exchange for credit.
3.3 The User will be responsible for the accuracy and completeness of the information provided in the Sales Form.
3.4 After completing the Sales Form, an automatic quotation will be displayed that corresponds to the credit offered by the 2nd Hand item. By agreeing with this quotation, the User can choose to submit more items or proceed with the submission of a single item.
3.5 Submission is only effective after Signing In/Registering on our sites.
3.6 After Signing In/Registering, the User will receive an email with confirmation of the submission of their 2nd Hand items, next steps that the User must follow and a code or Waybill for shipping purposes.

4. SENDING THE 2ND HAND ITEMS
4.1 The User will receive an email from WHITE STAMP with all information regarding the submission of 2nd Hand items submitted. The submission of any 2nd Hand Item to WHITE STAMP indicates that the User agrees to provide his item to WHITE STAMP for the quotation offered.
4.2 The User has 7 days to send the 2nd Hand Items which he decided to exchange for credit. After this period, if the shipment has not been completed, the User will have to fill in the Sales Form again to obtain a new quotation for his 2nd Hand Items (the value of the quotations is subject to change).
4.3 In order to send the 2nd Hand Items to WHITE STAMP, the User must carefully pack their items, reusing a box/bag they have and that they consider suitable for this purpose. It must effectively hide all existing information (addresses, codes, etc.) that the reused box/bag contains under penalty of conflicting with the shipment to WHITE STAMP.
4.4. WHITE STAMP offers the User two different shipping methods:
Mainland Portugal – 1) Drop off at CTT stores or points; 2) Collection at an address chosen by the User.
Other European Union Countries – 1) Drop off at DHL Points; 2) Collection at an address chosen by the User.
4.5 WHITE STAMP is responsible for the costs of shipping the User's 2nd Hand Items to WHITE STAMP in Mainland Portugal and Islands. For other countries of the European Union WHITE STAMP supports the shipping costs for submissions of 2nd Hand items whose total value of quotations is equal to or greater than €100.
4.6 The User is responsible for including all materials and/or accessories belonging to the submitted 2nd Hand items. Failure to include these materials and/or accessories may lead to the item in question being rejected.

5. VERIFICATION RESULT OF 2ND HAND ITEMS
5.1 As soon as the 2nd Hand Items arrive at WHITE STAMP's facilities, our team will verify them. All Second Hand Items will be manually inspected to assess whether they comply with the Conditions of Sale and the description provided in the Sales Form.
5.2 Upon completion of the verification, the User will receive an email from WHITE STAMP with the detailed result of the verification of the 2nd Hand Items sent. This check may have three possible results:
5.2.1 Approved – when an item meets the conditions of sale and the description submitted. In this case the credit will be available for immediate use.
5.2.2 Re-evaluated – when an item meets the conditions of sale, but does NOT meet the submitted description. In this case, the User is presented with the options to request the return of the 2nd Hand item in question, or to accept the proposed new quotation. The reason for the re-evaluation will be duly justified and confirmed by email. In the absence of a response within 3 days, the credit corresponding to the new quote offered will automatically be deposited in the SELL 1 BUY 1 Account.
5.2.3 Rejected – when an item DOES NOT meet the conditions of sale. In this case, the User is presented with the options of requesting the return of the 2nd Hand item in question, or of donating it (to a Private Social Solidarity Institution or for recycling – depending on the status of the item). The reason for rejection will be duly justified and confirmed by email. In the absence of a response within 3 days, the 2nd Hand item in question will automatically be donated.

6. CONDITIONS OF SALE
6.1 WHITE STAMP has the right to refuse 2nd Hand Items where one or more of the following situations occur:
Stains, Pilling, Patches, Odors or sweat marks, Missing parts, Broken parts, Alterations, Shrunken item, discoloration, Cut labels, Counterfeit item, Brand not listed on the Sales Form.

7. RETURN OF 2ND HAND ITEMS
7.1 The User may request the return of 2nd Hand Items sent to WHITE STAMP, whenever an item is re-evaluated or rejected, upon payment of €10.00 (shipping costs + logistics).
The return request after a re-evaluation must be made within a maximum period of 3 days through the email address: customercare@white-stamp.com.
The return request after a rejection must be made within a maximum period of 3 days in the email with the verification result.
7.2 2nd Hand Items sent to WHITE STAMP become the property of WHITE STAMP and cannot be returned to the User in the following cases:
7.2.1 2nd Hand Items submitted by the User and approved by WHITE STAMP;
7.2.2 2nd Hand Items sent by the User, re-evaluated by WHITE STAMP, without a return request after the 3 days defined in point 7.1 as the maximum period for requesting a return;
7.2.3 2nd Hand Items sent by the User, rejected by WHITE STAMP, without a return request after the 3 days defined in point 7.1 as the maximum period for requesting a return.

8. PAYMENT
8.1 Payment is made in credit format. No cash payments will be made. Credit cannot be exchanged for cash.
8.2 The credit equivalent to the 2nd Hand items received is immediately available after verification and consequent communication.

9. CREDIT AND DISCOUNT CODES
9.1 The credit can only be used on Partner Brands.
9.2 The User may create discount codes to be used in various purchases, in the different Partner Brands. From the moment the discount code is created, it will have to be used in the Partner Brand where it was created.
9.3 The percentage of the total purchase amount that can be paid with credit is defined by each Partner Brand.
9.4 The credit has no expiration date.
9.5 Discount codes cannot be combined with each other.
9.6 Discount codes can be canceled by the User in the SELL 1 BUY 1 Account if they have not yet been used.
9.7 Discount codes created for a Partner Brand that is no longer part of the SELL 1 BUY 1 program can still be used in that Brand.
9.8 Discount codes created for a Partner Brand that has ceased activity, if not used, can be canceled by the User in the SELL 1 BUY 1 Account. Consequently, the credit will once again be available in the SELL 1 BUY 1 Account for use in any other Partner Brand .
9.9 In case of termination of the SELL 1 BUY 1 Program, users will be notified and will have a period of 90 days to transform the unused credit into discount codes for use in any Partner Brand. After this period, the credit will no longer be available.

10. WARRANTIES
10.1 The User warrants to WHITE STAMP that:
a) You are the owner of all 2nd Hand Items that you send to WHITE STAMP;
B) You are over 18 years of age;
C) You have the legal right to send us your 2nd Hand items;
D) All 2nd Hand items that the User sends to WHITE STAMP comply with the Conditions of Sale and with the description provided in the Sales Form;
e) 2nd Hand items and respective submission do not violate any law, statute or regulation;
f) 2nd Hand items and respective submissions are not obscene or pornographic and do not contain child pornography;
g) 2nd Hand items do not contain ivory or any other animal substance from endangered/endangered species;
h) 2nd Hand items are free from infestations, such as moths, insects, larvae and other living organisms;
i) 2nd Hand items do not infringe the intellectual property rights of third parties (including copyrights, trademarks, patents, trade secrets or other proprietary rights);
j) 2nd Hand Items are not counterfeited, stolen or fraudulent.
10.2 By participating in the SELL 1 BUY 1 Program, the User agrees to indemnify WHITE STAMP for all claims or losses suffered by WHITE STAMP as a result of any breach of the guarantees mentioned in point 10.1.

11. COMPLAINTS
11.1 In view of the objective of continuous improvement of the services provided, WHITE STAMP will seek to answer and resolve the complaints presented by the User within 5 working days, through the email customercare@white-stamp.com.

12. EXCLUSION AND LIMITATION OF LIABILITY
12.1 WHITE STAMP does not guarantee the uninterrupted operation of the Sites and Services, or any of their functionalities, and they may be suspended for maintenance, repair or updates.
WHITE STAMP will not assume, likewise, any responsibility for any damages, arising, directly or indirectly, from force majeure situations that prevent WHITE STAMP, in any way, from fulfilling its obligations, namely, strikes, failures in the electricity network, in telecommunications services or in any other services, fires, floods, impossibility of obtaining products, materials or services, damages, delays by suppliers or transporters and changes in legislation or administrative regulations.
WHITE STAMP is not responsible for any misuse of the User's access data to the website by third parties, as they are personal and non-transferable.

13. MODIFICATION OF TERMS AND CONDITIONS
13.1 WHITE STAMP reserves the right to change, at any time, these Terms and Conditions, considering the changes made and the Users notified by publishing the modified Terms and Conditions on our Sites (www.white-stamp.com).

14. PERSONAL DATA PROCESSING
14.1 We ask that you carefully read our Privacy Policy so that you can become aware of the rules and procedures adopted by WHITE STAMP regarding the treatment of data collected when browsing our Sites and when using our Services, as well as security and confidentiality rules apply.

15. PRIVACY POLICY
15.1 WHITE STAMP only uses the User's personal data in accordance with the Privacy Policy. We ask that you take the time to review it carefully, as it contains important information on how we collect and use your data. By using our websites, you consent to the use of your data as described in the Privacy Policy and ensure that all data provided by you is trustworthy.

16. PROOF AND FILE
16.1 The computer records, kept by WHITE STAMP in safe conditions, are considered as proof of communications, submissions, returns and exchanges made between WHITE STAMP and the User.

17. APPLICABLE LAW
17.1 These Terms and Conditions and all emerging disputes that are related to them, including their validity, the use of the Sites and Services shall be governed by Portuguese Law.
